Introduction

OTT platforms have disrupted the traditional media model by allowing content to reach audiences without conventional theatrical or television distribution. This flexibility has created enormous commercial opportunities but has also made regulatory compliance considerably more complex.

In India, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 provide a framework relevant to intermediaries and publishers of online curated content. The framework has continued to evolve, including amendments published in 2026.

Content Regulation Is Only One Part of Compliance

OTT operators must consider classification, grievance mechanisms, content standards, contractual rights and regulatory directions. A platform may possess a valid licence from a producer but still encounter problems if the underlying rights do not extend to every territory or medium in which the programme is made available.

Privacy and Viewer Data

Streaming platforms possess detailed information about viewing behaviour, account usage and consumer preferences. Privacy compliance therefore becomes a commercial issue rather than merely a technology issue.

India's Digital Personal Data Protection Act, 2023 establishes a framework concerning digital personal data, with provisions being brought into force in stages.

International Operations

A global OTT platform may simultaneously encounter different standards concerning privacy, children's content, advertising, hate speech, copyright and consumer protection. A single global policy may therefore require jurisdiction-specific adaptations.

Conclusion

OTT compliance should begin before content reaches the platform. Rights acquisition, content review, privacy, consumer terms, grievance systems and international distribution should be treated as interconnected legal functions.

The strongest OTT businesses will not merely respond to regulatory complaints; they will build compliance into the architecture through which content is acquired, processed, classified, distributed and monetised.
